Where is a prenup kept?
The short answer
A prenuptial agreement is usually held by the attorney who drafted it, by one or both spouses, or in a safe deposit box or private vault. Whoever holds it, the original needs to survive decades and stay producible by the person who needs it.
The longer answer
Law firms merge, close and purge files, and no firm owes you custody of your original forever. A copy kept at home shares the fate of the house — fire, storm, flood — and in a separation both spouses have access to it. The practical answer most family-law attorneys give is that each spouse should know where the original is and be able to reach it independently. A box rented in one person's name, or in the name of a trust, does exactly that.
